1. Eligibility and accounts
You must be at least 18 and able to form a binding contract. The service is not directed to children under 13. You are responsible for accurate account information, protecting credentials, activity under your account, and promptly reporting suspected compromise. Invite-only access may not be transferred.
2. What Genesis provides
Genesis is an AI-assisted project operating environment. It can organize project context, draft work, use connected services, and propose or perform actions subject to available capabilities and approval controls. Features labeled alpha, beta, preview, or experimental may be incomplete, change, or stop. Genesis is not a substitute for legal, medical, financial, tax, safety, or other licensed professional judgment.
3. Your content and connected services
You retain ownership of content you submit. You grant Genesis a limited, worldwide license to host, copy, process, transmit, and display that content only as needed to provide, secure, support, and improve the service. You represent that you have the necessary rights. Connected services are also governed by their own terms; you authorize Genesis to access them only within the permissions you grant.
4. AI output and approvals
AI output can be inaccurate, incomplete, or similar to output provided to others. You must review output appropriate to its risk. Genesis approval controls reduce unintended consequences but do not transfer responsibility for instructions you approve. You may not bypass safety, authorization, spending, publishing, deletion, or access controls. We do not guarantee that any model or provider will always be available.
5. Acceptable use
You must follow the Acceptable Use Policy. You may not use Genesis unlawfully, infringe rights, compromise systems, deceive people about material AI involvement, or place the service in control of high-impact decisions without appropriate human review.
6. Plans, usage, and taxes
Private-alpha access does not automatically convert to a paid plan. Paid-beta plan terms, included Genesis Compute, automatic-reload controls, and any applicable taxes are described on the Pricing page and at Stripe checkout. You authorize only the subscription and reload charges you explicitly approve. Genesis does not store full payment-card data. Failed, disputed, or authentication-required payments may pause paid AI capabilities without deleting project data.
If you enable automatic reload, you authorize Genesis to charge the saved payment method whenever your displayed balance reaches your chosen threshold, for the chosen reload amount, until the monthly cap is reached or you turn the setting off. The account records the consent version and time. This authorization is separate from membership renewal and is off by default.
7. Automatic renewal and cancellation
A paid subscription renews automatically for the disclosed interval until canceled. You may cancel online through account settings or the Stripe-hosted billing portal without calling support. If you cannot access the online control, email hi@genesis.build. Cancellation stops future renewals and normally takes effect at the end of the paid period. We will provide a retainable enrollment acknowledgment and legally required renewal, trial-ending, and price-change notices. Material price increases apply no sooner than the notice shown to you. 8. Genesis intellectual property
The service, software, design, and Genesis marks are owned by Genesis or its licensors. Except for rights expressly granted here, no rights are transferred. Feedback may be used without restriction or payment, but we will not identify you publicly without permission.
9. Suspension and termination
You may stop using Genesis or delete your account. We may suspend or terminate access for material breach, security risk, unlawful use, nonpayment, or to protect people or systems. When practical, we will provide notice and a chance to cure. Sections that by nature should survive—including payment, ownership, disclaimers, liability, and dispute terms—will survive.
10. Disclaimers
To the maximum extent permitted by law, the service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Nothing here excludes warranties or rights that cannot lawfully be excluded.
11. Limitation of liability
To the maximum extent permitted by law, Genesis is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, or business interruption. Our aggregate liability arising from the service will not exceed the greater of $100 or the amount you paid Genesis during the 12 months before the event. These limits do not apply where prohibited or to liability that cannot lawfully be limited.
12. Indemnity
To the extent permitted by law, you will defend and indemnify Genesis from third-party claims arising from your unlawful use, your content, your connected-service instructions, or your material breach of these Terms. This does not require indemnity for Genesis’s own misconduct.
13. Governing law and disputes
Wyoming law governs, without regard to conflict-of-law rules, except where your local consumer law requires otherwise. State and federal courts with jurisdiction in Wyoming will have exclusive jurisdiction, unless applicable law permits you to bring a claim elsewhere. Before filing, each party agrees to send a written notice and attempt informal resolution for 30 days.
14. Changes and contact
We may update these Terms. Material changes will be announced in the service or by email and will state when they take effect. Continued use after that date means acceptance; if you disagree, stop using the service and cancel before the effective date. Questions or legal notices: hi@genesis.build.
